Terms of service

By accessing www.bizsparkstudio.com, purchasing a product or service, submitting payment, or engaging Biz Spark Studio for services, you agree to these Terms of Service and any additional policies, service descriptions, proposals, invoices, or agreements applicable to your purchase.

SERVICES & ORDERS

Biz Spark Studio provides creative, branding, graphic design, marketing, digital, website, social media, print, merchandise, NFC, event branding, consulting, and related services and products.

Service availability, pricing, deliverables, turnaround times, and requirements may vary by project.

Biz Spark Studio reserves the right to decline or cancel an order when necessary, including orders involving unavailable services, suspected fraud, abusive conduct, prohibited content, pricing or listing errors, or projects outside our scope or capacity. If Biz Spark Studio cancels an order before work has begun, any applicable amount paid for unperformed work will be addressed accordingly.

PAYMENTS

Payment must be made through an approved Biz Spark Studio payment method.

Payment in full is generally required before work begins unless a deposit or installment arrangement has been approved in writing.

Eligible projects may be offered deposits or payment installments. The applicable payment schedule will be stated on the invoice, proposal, checkout, or client agreement.

Any remaining balance must be paid according to the agreed payment schedule and before applicable final deliverables, products, credentials, or files are released.

Available third-party payment or installment options may be displayed at checkout and are subject to the provider's separate eligibility requirements and terms.

CUSTOM & CREATIVE SERVICES

Creative and professional services are subject to the applicable Design & Creative Services Policy, service description, proposal, invoice, and/or signed Client Service Agreement.

Turnaround begins only after all required payments, agreements, information, content, access, and other requested materials have been received.

CLIENT RESPONSIBILITIES

Clients are responsible for providing complete and accurate project information and for having the necessary rights and permissions to any content, logos, photographs, trademarks, copy, or other materials submitted to Biz Spark Studio.

Clients are responsible for reviewing drafts, proofs, project information, shipping information, and final deliverables for accuracy before providing approval.

Delays caused by missing information, late responses, changed instructions, or unavailable access may affect the original project schedule.

PRICING & SCOPE

Prices are subject to change. A price change will not retroactively change an already-paid order unless the client requests additional work or a change in project scope.

Work requested outside the original purchased or agreed scope may require an additional invoice.

INTELLECTUAL PROPERTY

Ownership and usage rights for custom creative work are governed by the applicable Design & Creative Services Policy and/or Client Service Agreement.

Biz Spark Studio retains ownership of preliminary concepts, unused designs, internal processes, working files, proprietary materials, and other materials not expressly transferred to the client.

REFUNDS & CANCELLATIONS

Refunds, cancellations, deposits, customized products, digital products, and professional services are governed by the Biz Spark Studio Refund & Cancellation Policy and any applicable signed agreement.

SHIPPING & PHYSICAL PRODUCTS

Physical products and printed materials are subject to the Biz Spark Studio Shipping & Delivery Policy, including applicable production and carrier timelines.

THIRD-PARTY SERVICES

Certain projects may involve third-party platforms, vendors, printers, manufacturers, hosting providers, software, applications, or other services.

Biz Spark Studio is not responsible for outages, policy changes, account restrictions, shipping disruptions, platform changes, or other circumstances outside our reasonable control caused by third-party providers.

LIMITATION OF LIABILITY

To the extent permitted by applicable law, Biz Spark Studio will not be liable for indirect, incidental, special, or consequential losses arising from the use or inability to use a product or service.

Biz Spark Studio does not guarantee specific business outcomes, sales, revenue, followers, engagement, search rankings, funding, customer acquisition, or other performance results unless expressly stated in a written agreement.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

POLICY ACCEPTANCE

By completing a purchase, the customer acknowledges the policies presented or linked through the Biz Spark Studio website and checkout.

Projects requiring a Client Service Agreement will not begin until the required agreement and onboarding requirements have been completed.
